We need to know a lot more facts than what you have given here. The question would be whether obtaining information this way could lead to a motion to suppress. Research would have to be done.

The Father gave the Son property and home but is now denying any such thing even though they both have a copy of the notarized agreement. State documents of home are in Fathers name but mortgage is in both Father and Sons. What rights does the Son have to that home with just a notarized agreement?

The money from the sale went to the mortgage company. They got a deficiency judgment against you for the difference between what the property was sold for and what you owed under the contract, most likely.
