There is a strong policy in the State of Oregon that children general need a strong relationships with both parents. That said, whether that means you should be the custodial parent, or what kind of parenting time you should have depends on factors analyzed by the court on a case by case basis. There needs to be a hearing to determine custody and/or parenting time and you and your counsel need to be prepared to demonstrate why custody or particular parenting time that you propose is in the best interests of the children. Sometimes that might involve testimony of family and friends and possible a custody/parenting time evaluation by a MSW or PhD.
