Fairfax, VA asked in Family Law for Virginia

Q: What happens if defendant does a no show with Calander Control Judge, after being officially served?

Numerous attempts made my moving party to have conference call with CC (calendar control). Defendant either doesnt answer phone or hangs up right before judge is on line. Has been officially served with notice that moving party will be before CC judge within 48 hours. Numerous stall tactics, and court date stalled for 2 months.

A: Based on your description it is highly likely you are in Fairfax. In Fairfax a calendar control hearing can be held without the consent of the opposing party as long as there is proper notice. some judges will still refuse to hold the calendar control hearing. All of this presumes that you are represented by counsel. If you are pro se, then the judges will tend to give you slightly less deference for a calendar control hearing.

You need to consult an attorney.
