Hampton, VA asked in Real Estate Law for Virginia

Q: I bought my home 2 years and 3 months ago, seller hid issues in home. Can I still sue? Please help!

We bought our home 2 years and 3 months ago. The seller hid various issues, to include water damage (entire bathroom sub floor, floor and shower need to be redone), duct work (entire system needs work), etc. They painted over weater stains and hid everything. Can we sue? Can we sue in civil court? We want them to pay for the cost of the repairs, if nothing else.

A: Often for residential home sales there are provisions in your sales contract providing that the sale is "as-is" or that there are no warranties regarding the condition of the property.

You could try a lawsuit, but your chances are heavily limited by your contract terms. Find a real estate litigation attorney in your area, and bring your sales contract (including all addenda), the deed, and all closing documents to your consultation.
