Q: I need to know who should pay for my medical expenses after an accident in a giant food store

I slipped on some grapes on the floor and was sent to the ER where I was told I had reuptured my achuilles tendon looks like a long recovery and alot of medical expenses. I paid for the ER visit but not sure if this is something I should pay for given that it looks like it may be alot of monrey

A: Unfortunately an online post cannot fully analyze a personal injury claim. An injured party who spends money on medical expenses caused by someone else can sue to recover those fees. To win a slip & fall case (and get compensated for medical expenses) a plaintiff needs to prove that the store breached some duty it owed. Whether or not the store would be responsible in a particular situation depends heavily on the facts, including what the company did to maintain its store, what the specific "hazard" was and so forth. A store is not usually responsible for every injury occurring at its location, only those injuries from dangers it should have removed.

A: These are uphill cases to say the least. But one quick piece of advice unrelated to the merits of your claim: ask the store if their insurance policy has med pay. Their may be some insurance available to you by the mere occurrence of the accident on their premises (basically no-fault insurance that will not impact you liability claim)
