Midlothian, VA asked in Workers' Compensation for Virginia

Q: I have a doctor that has told me I could no longer work, but I was denied workmans comp because his office help problems

Now I am trying for disability and I am running into the same problems. He also can't remember from month to month what he says he is going to do. Unfotunatly I think he has otten into the booking four patients in one slot and so you wait at least four hours to be seen and then you get rushed out the door. If I ask if I can ask a question he says no because this is his clinincal opinion. I just feel like this abandoment but because he took me out of work inthe firs place I am unsure what to do.

A: You have a difficult problem. With your WC claim, you would need to be able to prove an accident and disability caused by this accident. This does require medical evidence. It certainly does not sound like he can help you with your disability case. Not only would you need an opinion explaining how you are so functionally limited that you are disabled but you have to show treatment records from that doctor and tests that support that opinion. You probably need to get another doctor. Or, perhaps you can agree to pay for an hour of his time and get him to provide you a functional analysis. Good luck!
