Miami, FL asked in Domestic Violence for Florida

Q: My husband hit me what would happen under Florida Law?

2 wks ago my husband slapped me4first time. Days later he slapped my back & threatened with a belt: if you dont shut up i kill you. Now it was more severe. He hit me with wooden spoon on my leg i have a blue mark, after kicked in my bum, kicked when i was sitting with him+took a long pillow and hit me against my head. I do generally believe he has a big mental problem! He is very sorry and said he didnt use full power, still says its bad. Now he wants to report himself. What would happen? Would i be questioned? What if i refuse to talk, would he still be arrested? How long? On the other hand: i would like to report him just as a safety measure with NO consequences like jail! We also file for my greencard and im worried! We want to give our marriage another 6 mths, we just married in August. He said he wont do it again. He does this all in his anger and says he is blind then. Yes he is like a different person, talking differently and nonsense. He also is worried that he could kill me.

A: If you call the cops, someone will go to jail, and it might just be you if he lies and says that you hit him. It is a crime to hit people, and they go to jail, sometimes for up to a year.
