Q: Can I file for a custody modification because my ex is unemployed?

I am the children's primary parent and I share custody with their father who lives in illinois. I am currently between hearings of a motion for contempt/enforcement regarding child support and a vehicle that is still in my name. At the first hearing for the motion for contempt/enforcement, my ex stated that he is now unemployed and that is why he cannot pay child support. The current judge will be dealing with the child support and the vehicle on 3/20/13 but my children are supposed to go to chicago 3/22/13 for spring break for a week and in june for summer break for 8 weeks. I am worried that if he is unemployed that he will not be able to adequately provide for my children while they are there since he is already unable to pay for their support now. Can I file for a custody modification to prevent them from going?
