Q: Can I re-open my divorce settlement?
Didnt have any representation when divorced, feel I deserved more. The house is still in both of our names, I am still on ex's bank accoutn. He is now asking for a quit-claim deed to sign the property over to him free and clear? What are my options?
A: You may, based on fraud or mistake. Suppose, you settled and years later for the first time discovered the other spouse had an asset that was community property. Then you can petition the court to reconsider the settlement and distribute the newly discovered asset.
