Q: In a case where the garnishee did not garnish- the debtor still lost intrestin wages when the garnish order issued?

Debtor later filed for bankruptcy but wages that should have been garnished and turned over - they should not be considered part of the debtors estate. I should be able to collect from garnishee, right?

A: Everything is put on hold when you file bankruptcy, and you would have to claim that the money being held in the garnishment is exempt. Otherwise, the trustee may well get it. Seek advice from a bankrutpcy attorney in your area.
