Q: I won a wrongful termination suit against a texas company. i never recieved any payment and was told they filed bankrupt

A: You can confirm if they filed Bky by Signing up for PACER, it is a free governmental service, as long as you use less than $15 a calendar quarter. Then sign on at the District Court's Bky Site for the specific district and perform a search. From the Docket you can print copies of the documents filed.

If they did not file Bky, you should seek an attorney to collect.

You need to contact the Attorney who represented you in the termination case in Texas in writing asking them if they are enforcing the Judgment or if not, why not? They have a likely legally assigned ownership interest in a potential Judgment and you have to respect that contract if they worked on a contingency fee. If another Attorney steps into this matter without them releasing their potential claims/interest, that attorney and your could be sued. If you can't reach the Attorney who did the case for you after trying repeatedly in writing, then have a licensed Texas Attorney send them a letter asking if they are waiving their claimed interest from the case. If so, then with that written release, you can proceed with getting a new TEXAS lawyer. If your asked to sign anything giving a percentage of anything to a non-Texas and as such non-licensed lawyer, please file a complaint with the State Bar of Texas Unauthorized Practice of Law committee. I very much doubt that contract could be lawfully enforced since such an action is a potential crime.
