Q: My husband is in jail for his 1st probation violation. Is it his lawyers responsibility to obtain medical records or his

My husbands violation is for not reporting to his p.o when she said to. No new criminal charges. He has had a lot of medical problems. Multiple hospital stays during the time she wanted to see him. His original charge happened 10 years ago. They won't let him out of jail.

A: I'm sorry, I guess some of your question got cut off. But I can't imagine a situation where it would be a lawyer's absolute obligation to obtain your husband's medical records, unless the lawyer specifically promised he would do so as part of the representation in his retainer agreement with you. In general, lawyers can require clients to obtain their own records when such records are necessary, if that is what the lawyer and the client agree to. Again, your question is not fully posted here, so I might be misunderstanding.
