A: Not sure what you mean. I hope you have a will. In the will, you would name a personal representative to be in charge of probating your estate. That personal representative does not have to hire an attorney but many people find the whole process overwhelming and do. in such case, the personal representative gets to select a probate lawyer.

If your child is a minor (under age 18), then your will would appoint a guardian to care for the child if the child's other parent is not around or is unsuitable for whatever reason. The will would also appoint a trustee to handle any money or land that you would leave to the child. Even children who are over 18 sometimes need a guardian or trustee. If the child is disabled, he or she may need a permanent guardian. If the child is not disabled but is not very responsible with money, then the parent may want to leave the money in trust for the child to have the money be overseen by a trustee and doled out over time so that the child does not spend all the money at once. Young people and oodles of money are a bad mix.

If you are thinking about making a will, then I suggest that you seek out an experienced estate planning attorney who will review your situation and tell you what you need.
