A: Your question indicates that you have already filed for divorce. If you have an attorney you should rely on his or her advice for the answers you seek. Obviously you will need to prove that the child born while you were separated is not yours. This will require more than confessions. It will require DNA. Your lawyer can further advise you on this. It sounds like you have another child. You certainly have visitation rights with her. You might want to talk with your attorney about seeking a temporary order that helps to guarantee your visitation rights during the divorce. You are going to incur significant legal fees in this thing, particularly if your wife is going to be obstructive. Set up a deal where you are paying your lawyer a monthly amount so that he/she knows that you are willing to pay. If you don't have an attorney already, I'll be happy to speak with you about this matter. While I have discussed the general provisions of the law, there are some exceptions. So you shouldn't rely on this note as a legal opinion. If you click on my name it will take you to my contact page. There you can find information on how to contact me, either by phone or by email. I don't charge for the first 30 minutes of an initial consultation.
