Chicago, IL asked in Criminal Law for Ohio

Q: WHAT KIND OF PUNISHMENT AM I LOOKING AT FOR CASHING OUT A $90 TICKET AT THE CASINO? OFFICER SAYS ITS A FELONY

The casino was aware that I would walk around looking for cash left in the machine. I had been doing it for about six months. Some of the workers would let me know if there was money left in a machine. This time the person who left it came back but I had already spent the money. Can these charges really stand even if the casino knew the entire time I was doing this. They had told me on one occasion that the were watching me and since I wasn't gambling I had to leave. They allowed me to cash out the tickets as long as I played them right back.

A: In my opinion, your problem is that the person who left the money came back for it. The victim is that person, not the casino. The fact that the casino was aware of your prior activity doesn't matter. As far as that person is concerned, you stole their money. From past experience with this issue, if a person leaves money in a machine and comes back for it, they can tell the casino what happened. The casino then watches the security video to confirm that the person left money in the machine, and to figure out who took it. Usually, a police officer is called and tells the person in your shoes that if they give back the money, there won't be any charges. But if you refuse to return the money, the cop will arrest you.
