Q: My husband served me with divorce papers in 2008 but didn't finalize. I want to finalize now, how do I do that?

My husband served me in 2008 and I didn't have the money to respond. We reconciled for a period. In April of 2014 his lawyer sent me papers to sign that supposedly would finalize the divorce and both my husband and the lawyer said they were filed. I don't have a copy and the courthouse says they aren't filed. I was planning to remarry in March. Can I respond to the 2008 papers and be considered divorced prior to March 2015?

A: Even if you are not planning on hiring an attorney, you should probably meet with one to help you assess where the case is at. The answer to this question depends on where your case is in the legal process. There are numerous things that could have happened since 2008. Has the case been dismisses? We're you served? Have you been defaulted? Have you each done a preliminary and final declaration of disclosure? The list is virtually endless.

Seek the help of a professional to review your file. If you cannot afford an attorney, at the very least call a paralegal to help you.
