Q: In an abusive household, can the mother leave the state with children born in RI?

Relationships are difficult, sure. But one is not required to live unhappily. Unmarried, this couple has children...the father says since the child has his name the mother can be "locked up" if she wants to get herself and her children away from such situation. Seems like bull$#!t but I don't study law and I know there are much stupider ones if this is one that stands true. Thank you, concerned family member

A: If there are any threats of imminent physical violence, have the victim seek assistance with any of the RICADV agencies (http://www.ricadv.org/en/) and consult with legal counsel. Generally, a party may do ANYTHING the court permits them to do by way of ORDER after hearing the facts and testimony of the parties. The process usually begins with the victim seeking the assistance of the court through a petition for a restraining order/ no contact order. There is no guarantee the court will decide to allow the party to relocate. If the court can find a solution to allow the parties to separate, allow the children to have some contact with their natural father, and enjoy the love and support of thoughtful family members like yourself, that is often preferred. Sadly your family member has chosen to have children with this individual and they are the ones that must figure out how to best manage their co-parenting obligations.
