Fort Pierce, FL asked in Probate for Florida

Q: would a lie in a last will that states benificiary was "soon to be wifes sister" be a mistake of fact?

OUr father died aug 2013, none of us knew of a will. Then almost 9 months later lady comes forward with a will that she has been holding for 14 years saying she is 100 percent benificiary. This lady was our fathers second wifes friend but in this supposed will it says she was his soon to be wives sister. This is a lie we believe our father thought she truly was her sister and would be around at the time of thier deaths to pull the plug if we couldnt because our mother had just passed od a horrible cancer 6 months before these ladies got him to sign this supposed will and we believe he thought he was making a living will.

A: I do not have enough facts here to be able to give you any solid answers. You need to go see a probate attorney about this problem.
