Q: My ex girlfriend has marijuana possession charge and her brother who lives with her does too.They both continue to smoke

They also have there drug dealer over all the time.can i take her to court for custody of our daughter?Both have gone through probation and had the charge expunge.I dont want my daughter around her anymore if she continues to smoke.while she is a good mother i dont trust her brother or her drug dealer.

A: You need to hire an attorney to perhaps file a paternity action if paternity has not yet been established in court.

A: If there is drug use in the home then you should file for custody asap. Use of a lawyer is recommended.
