Chicago, IL asked in Traffic Tickets for Illinois

Q: I got a speeding ticket I was going 75 in a 45 speed zone. But I completed the 4 hour class and the 8 hour class and

Got put on supervision... But I got stopped today 01/26/15 the judge told me if I get caught speeding again they will suspended my license.. But the cop ran my name and I only had one conviction back in February2014 and that's the only one he saw in his computer.. I have to wait for the letter to come in the mail to show up to court. Is it possible that I might get my license suspended.? Or can I do community service or something. I do a lot of community volunteering and and work fulltime helping the elderly.. Please let me know what you think..

A: Based upon what you've said, you are most likely under 21 years old. Traffic School is typically a requirement of anyone under 21 receiving an order of court supervision. If you are under 21 years old, you are held to a stricter standard as your license is new. The secretary of state will only allow you to have two moving violation CONVICTIONS in a 24 month period. Note that convictions are not the same as court supervision which don't count. Additionally, you can only receive supervision at most twice in a 12 month period though in practice.

What the judge said suggests one of two things: you have used up all your supervisions for some time and any new moving violations MUST enter as convictions (after two, the secretary will suspend) or that the judge is prepared to revoke your supervision and enter a conviction if you violate your supervision by getting another ticket.

Either way, you do face a very real threat of a license suspension for at minimum 1 month though more likely 3 months or more. Because of the risk to your license, I would highly suggest considering hiring an attorney and presenting them with a court purposes abstract (you can pick one up at the DMV for $12.00). Simply put, you will want an attorney to at the very least look over your driving history and spot pitfalls which may lead to suspension.

I can however say that you can walk away with your license but it is certainly a cause for you to tread carefully.

I hope that helps.
