Q: Can I get custody of my 2 sons if I am on child support?

I have 2 sons and their mom currently has me on child support which I am currently paying. She just had 3 more kids within the past year so, she told me she cannot find a stable home with 5 kids and she wanted me to take my 2 boys. But, I don't want to take them and I still have to pay her child support. So, if she consents, do we have to go to the courts for custody of my boys and for my child support payments to stop. We both prefer to do things outside of the courts but, I know they would have to be involved some type of way since I am currently on child support in Florida.

A: First of all, you need to get an attorney for this. If you and the ex can resolve the differences amicably it can be written as an agreement, signed by both, and then ordered by the court. I think you should get the kids, they need you in their lives.
