Glen Allen, VA asked in Animal / Dog Law for Florida

Q: After living together for 4yrs I want to move out and take the dog with me, do I have legal rights?

I have been living with my fiance for 4yrs. About 3yrs ago he bought us a dog. The dog is registered to him because he made the online purchase. Now I want to move out. He is a drunk, mean and yells. Both myself and dog are afraid of him especially when he is drinking: every weekend. My fiance calls him velcro becase he never leaves mommies side. I want to leave but I dont want to leave our dog. Can I legally take our dog with me?

A: If you do, he could sue you for replevin, conversion, and civil theft. The dog is his, he can prove that he paid for it and it is registered to him.
