Hermitage, TN asked in Divorce for Alabama

Q: Divorce is fast approaching and I need advice on what to do with my savings account. It is not joint- see details.

The savings account was joint at first and we both out money into it, but I had to open a new account at the bank and they couldn't put my husband back on it because he wasn't there to sign. Since no one has filed for divorce yet, should I transfer that money? What are my legal rights? The account is solely in my name.

A: The account will be divisible marital property in the divorce, no matter that only your name is on the account. Do not attempt to hide assets in the divorce. You can put on evidence at trial that you alone contributed to the account, etc. However, you can't transfer the money in an attempt to hide the fact that it exists.
