Q: Im a father, we have not been to court can i get temporary custody of my son?

Can i take my son and file temp custody?

A: The thing for you to do is go see an attorney for a face to face discussion. You did not say whether you were married to the mother. That is important because if you were not, you basically have no rights until you file a paternity case and get your rights established by the court.

A: If not married to the mother then you have no rights until you go to court and establish your parental rights.
