CAR ACCIDENT

If you are asking about reopening the car accident, you CANNOT do that. That said, given the extent of your injuries, the insurance carrier probably surrendered their policy limits. That is to say that you probably received ALL available money.

Q: I was in a car accident in 2019 I settled my case but now I may have to get my leg amputated can I do anything else

Or can I take the lady to small claims court

It’s unlikely due to both the statute of limitations (since accident was in 2019) and the fact that there was a settlement. However if the amputation has some additional cause (medical negligence perhaps?), then it might be possible to recover in some other way. It’s best to contact a lawyer to... View More

Apparently, you posted the question about settling your claim in 2021. When you settle a claim, you release the Defendant from any liability that is in any way related to the events that took place on that date. As noted in my other answer, you probably received the policy limits. Contact the... View More

As my colleagues point out, it's possible the terms of the release and the timeline could present challenges. Most releases are worded to preclude future claims (unless you mean a claim based on med mal, which is usually a separate matter). This is something you should discuss with the... View More

You could. It could depend on a person's skills, knowledge, confidence, complexity of the claim, and determination of the carrier to defend. Many people have successfully handled their claims and saved on attorney fees. If the claim is complex (you post under bad faith, which could have its... View More

If I understand correctly, you were a passenger in your own car at the time of the accident. Your friend who was driving is currently incarcerated, and your car was impounded and has remained impounded for 10 months. Sadly, the towing and storage fees on your car may far exceed its fair market... View More

An Illinois attorney could advise best, but your question remains open for a week. Both of you would be liable to some extent - the vehicle for speeding (and other possible reasons, depending on whether it was in a crosswalk, traffic control device, etc.). You would be liable for being distracted... View More

Illinois law gives at-fault drivers/insurance companies 30 days to get you your settlement check from the date they receive your signed release. However, there are other factors that sometimes extend that time frame. For example, if you are working with an attorney and your attorney is negotiating... View More

Addendum - You mention other truckers encountering this road condition. If you contemplate pursuing entities involved in the design of the road, there could be notice of claim issues (short deadlines). If that is applicable, a local attorney could advise in more detail. Good luck

There is no fee for consultation. Your employer must have provided you with an insurance card. Did you call the insurance after the incident? Did they refuse to pay the claim? If they did refuse, why? We had a recent incident where a trucking company purchased insurance for two of its own... View More

Q: How long does it take attorneys to write up settlement release forms?

It could depend on the firm and the carrier. Some carriers want their own release forms to be used, so it's possible your attorney is awaiting a form from the carrier. For very complex cases, they could require some detailed attention. For more cookie-cutter cases, they can be boilerplate. Good luck

It would depend on how the settlement was reached and whether it was with an insurance company or private individual. Insurance companies take longer than a private individual. If it is a Court settlement, it is not suppose to take more than 30 days. If it is a private settlement, it is based on... View More

It is highly unlikely, if not impossible that you would be able to hold a lien holder liable. Any institutional lien holder like a bank, a credit union, Ford Motor credit, etc. requires both liability and collision coverage as a condition of the loan. Therefore if such a driver was uninsured, it... View More

It's unlikely. Lienholders are not treated as insureds or registrants. However, if the car is declared a total loss, the salvage end of the claim can involve the lienholder. Good luck
