I'm going to assume that this inquiry relates to a New York State criminal matter as opposed to a Federal matter. As to whether you are under investigation, you probably will not find out the answer to that question. After all, if you're being investigated, the investigation is likely... View More

You should hire someone new if you are not satisfied with your current lawyer. If your attorney is legal aid or 18b, you can ask the court to consider giving you a new lawyer.

You ask a good question. Because of your previous conviction, it may very well be upgraded to a felony under PL 265.02(1), CPW 3rd Degree, a class D felony. As to whether bail will be set or whether you will be remanded, I don't believe this is a bail qualifying offense even when upgraded.... View More

Q: I Failed to stop at stop sign. Ticket has a court date on it, cop says it’s not mandatory, just wanted to be sure.

This is the second ticket since May. I will plead guilty because I don’t want to go to court. I just wanna make sure when I do that I don’t have to show up for my court appearance.

A stop sign ticket has three points. You should not merely plead guilty because once you do, the points will be assessed automatically. As far as appearing in court, it is mandatory. The officer told you something that is completely untrue. If you fail to appear, they may issue an impending... View More

Speeding charges in NY are NOT misdemeanors. If he wrote you for reckless driving, that's a misdemeanor. However, speeding offenses are traffic infractions that involve 3 points, 4 points, 6 points, 8 points or 11 points depending on how fast one was traveling. Or in the case of VTL... View More

Due to the pandemic, the Court has the power to postpone cases. Once you're arraigned, speedy trial may be a mechanism by which you can obtain a favorable result. You should speak to an experienced attorney about your case. Good luck and be safe!
