Q: How do I go about early Federal Probation release?
Daniel Marc Berman

answered on Apr 2, 2012

Hire a lawyer in the jurisdiction were your case occurred. They will contact your probation officer and the US Attorney to get their input/position and then file a motion for early termination of probation. The Judge has complete discretion to grant or deny the request.

Depending on the Judge and numerous other factors, you could very well be looking at jail time if you go to trial and are found guilty by the Judge or Jury.

Without knowing the Plaintiff's or Defendant's names then it would be difficult to determine. If you knew the name of either party you could look up the case on your local county clerks web site and usually find the attorney information.

Daniel Marc Berman
Daniel Marc Berman
answered on Mar 15, 2012

You would need some sort of grounds to vacate the conviction. For instance, if you were not properly advised of the immigration consequences of a plea, or the judge did not perform a full and proper plea colloquy. Consult a local attorney to see if you have grounds. Be aware though that if the plea... View More

If the flooding was caused by the negligence of the repairer/marina, then yes, it sounds like you would have a decent lawsuit against them.

Q: WHAT DO YOU DO WHEN A LAWYER REFUSES TO HELP CLIENT AND SIDES WITHPROSCUTING ATTORNEY IN A CRIMMAL CASE?
Daniel Marc Berman
Daniel Marc Berman
answered on Mar 1, 2012

Fire that lawyer and hire a better one that will look out for your best interest. If it is a court appointed attorney and you cannot afford to hire your own lawyer, then you can make your feelings known to the Judge but it is unlikely to get you very far.

If you have no criminal history, the probably will just have to pay a fine and court costs. The charge is likely petit theft, a 2nd degree misdemeanor and is punishable by up to 60 days in jail.

Q: How many continuance may a plaintiff request?
Daniel Marc Berman
Daniel Marc Berman
answered on Mar 1, 2012

There is no number limit. Some Judges allow cases to go on longer then others. If you are the Defendant and you object to the continuance, then you need to put that in writing so that the Court is aware of it. Continuance requests are generally judged on a case by case basis.

My soon tobe x wife forged my name to a two party check , 1,100 do I have a case

Daniel Marc Berman

Call the police department were the forgery occurred. If that does not work, you can also contact the State attorney's office to try to get them to file charges. It might not be that strong a case since it was your wife though.

Unless you can somehow prove it was the fault of the grocery store, which seems like a stretch, then you will have to sue the vendor who did the damage directly.
