Q: Can a landlord ask for more than 30 days when cancelling a month to month lease?

I just got a renewal contract from my landlord saying that he needs 60 days instead of 30 for terminating the lease. What happens if I can’t notify in 60 days? He only gave me a 30 day notice to renew the lease.

Generally the parties can agree to whatever they want. If you cannot provide 60 days notice, you would probably be on the hook for the extra time.

Depends on the context, door-to-door sales, contract for the purchase of goods, employment contract, etc. Each will have its own method of getting out of a contract but they nearly all will depend on the other party.

If you're asking whether or not you can conduct business in the name of an LLC you own, in more than one location, the answer is probably. I imagine there could be local restrictions, website rules, mark licensing, or some other reasons particular to your brand that makes this question unanswerable.

Perhaps, but your remedy might be best positioned as a civil action, something along the lines of invasion of privacy or defamation.

the hallway doesn’t have any locks to prevent someone from entering the hallway but there are locks on the door

Adding to Mr. Morris, the presence of locks won't determine common spaces. The common spaces will be defined by the lease and by what some might call obvious common spaces. Anything outside the space you're renting exclusively, that you also have reasonable access to will be considered a... View More

Q: I was unfairly demoted due to false documentation presented by my supervisor. this has affected my pay. Is this a case?

It was proven the documentation was false because I held a meeting to see what was in my personal file and it was proven that she lied about the the amount of documentation she said she had.

There are a lot of things that can affect whether or not you have any rights here. But, if you're a private non-union employee, without a contract, you can probably be demoted for any reason or no reason, just the same as you can be terminated for any reason or no reason.

Well that is a complicated problem that depends. When it comes to leaving trash, almost certainly they cannot do that. When it comes to easements like the one you are describing, the sooner you act the better. You don't want the trespass to 'spring into an easement' in a month from now.

It is far to difficult to answer a question like this with precision. Your employer can *possibly* deny sick benefits to some and not others, but *probably* not in the manner you're describing (but it isn't obvious to me what is actually happening). But, the remedy for breach in this case... View More

I think the only way to know for certain is to have the restraining order reviewed. Remember you always have the ability to contact the police if he is contacting you and has a history with you bad enough that required a PPO. Reminding the police there is a PPO in place might also help them tailor... View More

I would think about this pragmatically. If you refuse, will you lose your job? Maybe. Would that be lawful? Maybe not. It might depend on the type of harassment and degree. It might depend on your employer's role in the matter.
