Q: What happens if my criminal tragic citation was not turned in when I arrived for my court date

I was used the citation while attending my sons field trip 2 hours from hom so I had to take off work and drive 2 hours to be told my citation wasn’t turned in yet and now I have received a new court date in the mail

More information is needed. What is the citation charge? Is your court date an arraignment? What county is it in? You should procure a lawyer whenever you're charged with a crime.

If the state attorney is already prosecuting the case, any plea offer or sentence to be imposed will involve restitution being paid back to you. Call the state attorney and get a status on where the case is as far as being resolved or going to trial.

It sounds like you are talking about an administrative suspension against your license, not a criminal charge. You are not a felon because of anything the DMV does to you. Have you been arrested or given a court date in Circuit Court?

The prosecution cannot simply use a victim statement or police report. Live testimony would be necessary to put on that evidence at trial

Q: A friend got caught with a gram of marijuana in Florida. He has a prior record from a few years ago.

He was not arrested and didn't recieve a citation but now received a letter in the mail for court. Any idea what he will be offered for the charge?

It's going to depend on the county and the outcome of that previous charge. Some counties have "decriminalized" small amounts of marijuana by deciding to decline to prosecute and issue municipal citations instead. He/She should get a consultation in the county where the incident is pending.

When you say that she “got custody,” That can mean 1000 different things. You need a lawyer to review that last order entered by the court and tell you where you can go from here. Per statute, you cannot receive a withhold of adjudication on DUI. Was the charge reduced?

Tell the judge that you need a continuance so that you can clear up your license before contemplating a plea offer. Get advice from a lawyer as well. It's not a good idea to represent yourself in criminal court

What do you mean "reported?" Are there pending charges or a warrant? Get a consultation at least by telephone so that you can give more info
