Since you were charged with distribution, you very likely need to speak to your attorney about this because he or she knows far more about the situation.

It would be better to hire sn experienced attorney for both phases, but you may be able to do the first one. You need the governor to give you back your civil rights, then an application can be brought in circuit court for the restoration of your guns rights.

Q: Can I refuse to testify as a domestic violence victim against my boyfriend?

Since you started the legal process by contacting the police and giving a statement, you will be required to be available to testify at any trial. If you are subpoenaed and do not show up to testify at court, the prosecutor can ask the judge to issue a warrant for your arrest. If you refuse to... View More

I doubt he will call the police. This is part of a scam including the threat to call the police. Don’t pay anything and stop talking to the girl. IF the police do bring charges, say nothing and contact an attorney.

You can not be arrested for responding to a scam. Simply ignore the "father" and the "daughter". Better yet, avoid the site you were using.

It is very difficult to predict the outcome at this point. Your friend's prior criminal history, if any, will have a significant impact on the outcome. Whether anyone could have been injured is another issue. Your friend's attorney will be in the best position to figure out a likely outcome.

Q: When charged in a criminal case, is it unusual to get a change of venue in Virginia?

Can a case be moved to a different county or jurisdiction?

Generally speaking, it is very difficult to get a chance of venue in VA. I tried, and lost, on the basis of incredible negative publicity AND postings on that jurisdiction's sheriff's website (so how could we get an untainted jury for trial?).

Don't post any more details on this public website. Proof of ownership is not really difficult in these situations. Wait to see if you are charged. Then hire an experienced local criminal defense attorney to fight the charge.

Q: I was wondering what could possibly be the outcome at court for a class 1 misdemeanor for assault first offense?

Likely you will be offered a first offender program: complete anger management, alcohol treatment if alcohol involved and maybe community service for dismissal of charge. Such a route is never eligible for expungement but at least a conviction is avoided.
