Q: I was in federal prison when my husband filed divorce he got the house I'm still on the loan how do I get off of it

The loan and the division of assets are different issues. I would recommend talking with a lawyer about filing a motion with the court that requires your husband to take over your liability on the house. However, because the loan was from the bank, I do not believe there is anything more you... View More

Q: How to handle people who won't leave a home the leased tenant moved out of?

These people moved in with a leased tenant and the leased tenant left. They refuse to leave and claim to have paid bills but can provide no proof. I am a brand new "mobile home park manager," and I don't know how to handle the situation. Rumors are flying that they've been... View More

You need to get a court order. Your first step is contacting a lawyer, I think.

Q: I have an ex-husband claiming to have 'banned' me from my favorite restaurant, police have not contacted me am I banned?

He does not work there, he just goes there often, and sees me there on occasions, we do not speak to each other, I do not cause problems, he claims he is close with the manager and that is how he has gotten me 'banned' So, do, I need to stop going to the restaurant? Is there further... View More

There are two ways you can be banned. First, a court may issue an order restraining where you can go. That did not happen here based on what you wrote.

Second, if the restaurant is on private property, the owner or the owner's agents (perhaps the manager) can tell you not to go on...

If you did not file a motion for the district court to change venue, then there is nothing for the appellate court to review.

Yes, that is enough evidence to establish probable cause of a crime being committed. Whether it will be sufficient to prove the specific crime beyond a reasonable doubt is a separate question. The question "willl this effect my probation even though this is for something I was arrested for BEFORE I did 6 months for a different charge" is something that, in my experience, only an attorney who practices in that court and before those judges can answer. I highly recommend seeing a lawyer.

In my experience, the reason why ethics complaints often do not result in a negative result is that the person filing it does not fully understand the jurisdiction of the bar association or the rules that apply to the alleged facts of the situation.

With that said, former hearing officers...

It's unclear what you mean by warning. If you mean an informal warning from a police officer without a ticket, then I can't see how the insurance company would ever know and, thus, there would be no impact.

Probably, although you did not give enough facts to make a complete judgement and, I believe, a full consultation would be needed. The maid's statement would give probable cause and the police can enter on the "emergencies/hot pursuit" exception to the warrant requirement.... View More

Q: do i have to do a legal divorce paper if we are seperated for more than 12 years?

We did a financial agreement ( because I was worried as he gambling habits were getting more serious) a year before we seperated and was recorded in court.

No, you still need a court order dissolving the marriage. In many states, the separation is the precursor the divorce (you did not list the jurisdiction). But it does not constitute the divorce order itself. www.lehmanlawgroup.com
