Q: I am in bankruptcy chapter 13 so why is the mortgage company trying lift the Automatic stay

I have been in bankruptcy chapter 13 since February 2018. I pay the trustee On time and is up to date I pay my insurance homeowners on time and all my bill.so why is the mortgage company trying to lift the automatic stay

Hello,

You will have to get permission from the Bankruptcy Court in order to refinance. This is considered a “new debt”. While in a chapter 13 your usually not allowed to take on new debt without getting permission. Talk to your bankruptcy attorney!

Filing for Bankruptcy takes about 4-6 months depending on how quick you are with getting together all of the requested information. Once the case is filed you will usually get a court date within 4-6 weeks of the filing. Keep in mind that if any issues do arise it could take longer!
