Q: Am I required to pay for my answer and counterclaim to be filed with the clerk if the petitioner has a lawyer

If you file your Answer and Counterclaim in person then you do not have to pay any fees. If you file your Answer and Counterclaim via PeachCourt or E-File Georgia you will have to pay processing fees once to use the portal and no additional fees after that.

Yes, in any case involving children and/or family legal issues a Domestic Financial Affidavit is required.

Q: In the state of Georgia, does the husband get better treatment if the wife files for divorce?

My estranged husband stated I should be the one to file divorce even though I didn't want a divorce, because if he files I'd be entitled to more support from him or something. Is this true?

It does not make a difference who files first in the divorce action, it does not mean one party will have preferential treatment over the other party.

I agree with my colleague. He should file for divorce and ask for parenting time. He must still abide by the conditions of his TPO. If he doesn't it could jeopardize his future parenting time.

No, you just need to indicate that it is a divorce Petition and the statutory grounds for the divorce. A few examples are are irreconcilable differences, adultery, or cruel treatment. There are 13 total grounds for divorce.
