If you are dealing with child support, then you do need a child support addendum. However, if you get married, the marriage itself legitimate the child, so you don't need to legitimate IF you marry the mother of your child.
It's not kidnapping. You both have equal rights to the child. If this continues, it's probably a sign your marriage is not headed in the right direction and you can file for divorce or separation and get a custody order.

Child support has ever been given. My question is if my sons father goes to court, can he get full custody? Also what steps should I be taking in a situation like this for precautions? I’m not even sure who technically has custody as of right now. Him or I.
If there is no court order, you have custody of your child. However, it seems that you have been sharing parenting time with his dad, which is a good thing. A court determines what's in the child's best interest regarding custody. If you have your son more now and the schedule is...Read more »

A few days later, we find out that there is a warrant for his arrest in GA that we believe his parents called and reported him for. But he did nothing wrong. Now his mother is harassing us and threatening us.
It is not required. If the report is not already drafted, it takes many hours to do that and will cost the parties probably an additional $5,000 at least. So they may have paid for the investigation, but the written report is more.

If you think your child is in harm or danger, then you shouldn't be ok with joint custody. Presenting a custody case is more than just giving the judge a parenting plan, but more about proving why that is in your child's best interest. Speak to an attorney in your area about your options.
