Sure you can! You even admitted to it! And you were observed driving recklessly! You best chance now is to keep your mouth shut. You did have a right to remain silent. Say nothing further to anyone except to a local criminal defense attorney! Good luck!

Perhaps is the most accurate answer I can provide. Much depends on the judge's temperament, how cooperative you've otherwise been with your PO and what the prosecutor view is of you. Public Defender's do NOT file Probable Cause Affidavits! Law enforcement and the State Attorney's office does! And they can be modified if an error was made.

It would not be the job of the lawyer who represented the Defendant to do anything. It would be up to the recipient of the restitution to file a claim for the unpaid amount against the Defendant's estate.
