Q: If I had a tire rotation recently (a month ago) then the tire is almost falling off a month later do I have a case ?

It was a big chain that did my tire rotation also took my tire off to fill a nail hole. I heard a vicious knocking under my car floorboard a few weeks later and when I went to mechanic he tells me my left tire was close to falling off as they failed to tighten the tire. This could’ve caused a... View More

I'm glad you weren't hurt! I had a wheel come off of my car while I was going 40 mph! Fortunately I wasn't hurt.

Regarding your question, almost certainly not. You would need to prove that you suffered damages (physical injuries and/or economic damages) AND that the big...

I agree with Mr. Scherr's assessment. Additionally, you may be barred from any recovery from the truck's insurer (for both property damage and any injuries you may have suffered) due to contributory negligence. You stated that the truck was "driving" and not stopped. If you... View More

Are you suing someone for child sexual abuse? If so, your lawyer is probably asking for your tax returns either to prove your loss of income, or because you have claimed loss of income and the other side is asking for them (and would almost certainly be entitled to them). If this isn't why,... View More

You would have to provide a lot more information for a personal injury lawyer to be able to make even a preliminary determination. The hard truth is that elderly people fall frequently, without anyone being negligent. There are lawyers who handle a lot of nursing home negligence cases (I'm not... View More

Possibly. With so much information available, determining the replacement cost for any particular vehicle is not like the old days when you would just open up the Kelley Blue Book, and adjust the value for the condition and mileage. You are entitled to an amount that would allow you to go out and... View More

Regarding the error in the police report, errors are not uncommon. Sometimes they matter, and sometimes they don't. The attorney you... View More

From the information you provided, you probably have a claim against this individual. The issue is collectability. You will have a hard time finding an attorney to take the case if any settlement/judgment is not collectable. You should contact a personal injury attorney to discuss this further.

I am a cyclist, so this "hits" close to home. The law in DC changed a couple years ago. In the "bad" old days, if a cyclist contributed to the accident, he/she could not recover due to a doctrine called contributory negligence. Now, fortunately, the law has changed as set forth... View More

DC law applies to the accident. If you were injured, you should contact a personal injury lawyer immediately. There are some things that, if not done soon after the accident, may hurt your case. For example, you want to get pictures of any property damage (e.g. car, bicycle) before it is repaired,... View More

Fortunately, the law in DC for collisions like this changed in 2016. Before that time, if you were even 1% at fault (and therefore "contributed" to the collision), you were barred from recovering anything. Now, per the statute below, that defense (contributory negligence) cannot be... View More
