Q: Who would be in violation if an unleashed dog runs up to a leashed dog and the leashed dog attacks unleashed dog?

The leashed dog was in front of its home and unleashed dog ran to it.

The owner of the unleashed dog would be liable for dog at large and the owner of the leashed dog could be liable for dangerous dog with the potential defense of provocation.

Q: Why am I being told I can't adopt my boyfriend dog back after the humane office took it

Yes you can still sue her for replevin. I’d also add claims for civil theft (possibility of being awarded attorney fees and triple damages), and also a claim for conversion which has a different mental state requirement than civil theft. The key is getting a show cause hearing set.

You can sue her in a replevin action and if the court agrees you’ve proved ownership the court absolutely can order her to return your cat and even issue a writ to law enforcement directing them to go seize the cat to return to you.
