Hello. No, until you are 19, you are covered under the Court order from your parent's divorce or custody matter. It sounds like you need to discuss this issue with your parents and let them take the necessary legal steps to make this happen. It has possible child support and tax implications,... View More

I am sad to read about this matter.

I am struck that you would follows anyone's recommendation to physically punish your special needs child. Have you ever attended your child's IEP review?

Have you ever sought out the independent ombudsmen who assist in these situations?...

Q: Do I have to file for custody of my 3 if my ex and I was never married and he is on their birth certificates?

You don't have custody at this point. Being on the birth certificate merely means you are presumed to to be the father.

You don't have custody. You have to make a filing in court to get that

Q: Can a 16 year old date and have a child with a 26 year old that is single and has two kids in the state of Alabama

First of all, "date" means go to the local burger joint together. It does not mean have sex with. THe 26 year old may well be contributing to the delinquency of a minor. She will probably not be liable on sexual abuse charges because his is 16 years old. The 16-year old, naturally, is... View More

Q: Can a 16 yr old decide to permanently move away from home without parental consent.

Is who they are living with right now breaking any laws by allowing them to live there without consulting the legal guardian at all and also moving out of town with the child without parents permission

You can't keep the child away from the parents. If there is a problem with the parents -- if they are unfit -- then a private custody petition would be in order.

With a good lawyer you probably won’t be found guilty of anything because under the facts as stated you didn’t do anything. With no lawyer you may get caught up in the system and not be able to avoid a conviction. On the brighter side, your friend is probably not guilty of the felony crime if... View More

Q: Am I responsible for court fees as minor? (Continued) thanks mr. Coleman

It was a juvenile court case. I know for a fact that once a child has legally become an adult the court fees/costs are transferred to that individual. What exactly will happen when I show up on that court date? Jail time for not paying court fees even though that's not legally possible as minor?

Mr. James Parrish Coleman
Mr. James Parrish Coleman
answered on Jan 4, 2018

The transfer of the liability for the fees is something with which I am not familiar. I don't know what role you played in the case. If you were represented by a next friend because you were a minor, you may be liable for the fees now that you are an adult. If you are still a minor represented... View More

You need to supply a few more details before I can attempt to answer. I am guessing that the mother of the child had the children picked up by the Alabama Department of Human Resources. After that there would be a 72 hour hearing and then DHR would work to put the children back with the parents or... View More

By "date" I assume you mean have sexual intercourse with you. If your 19 year old boyfriend has sex with you he will have committed a crime. You might want to read Section 13A-6-62 of the Code of Alabama. Your father is correct. He would will commit rape in the second degree if he has sex with you.

Unless you are emancipated (that is, 18-years old and completely self supporting) you are still a minor and subject to the control of your custodial parent. However, at 18 years of age, the juvenile system is limited in what it can or will do in terms of dependency or granting a petition concerning... View More
