If it’s been two years you have a FTA warrant and you can’t get that off unless you talk to the judge. Write the judge a letter and tell him you want to pay it, to set aside the FTA. Most of them will do it.

You need to call the General Sessions Court for whatever County you got cited in. Then inquire about your Citation. There is no DOT in Tennessee, so it was some other agency. Read your Ticket verbatim, then talk to the Clerk about what to do about it. If possible, go to Court to see if there... View More

Q: Can additional charges to a traffic stop that resulted in a charge but successfully defended against be dissmissed?

Lawrence Co. Alabama; As I approached the stop sign where co. Rd. 208 intersects the corner of co. Rd. 203 a state patrol rounded the corner aprox. 3-400m behind. The wheels of my car stopped and the momentum shifted backwards. I let off the brake and crossed the line to peer right, around the... View More

A lawyer would need more information before answering the question specific to your case, however, if multiple charges arise from a traffic stop, you can be convicted of those additional charges even if the ticket that was the reason for the stop is dismissed. In these situations, it's best to... View More

If he has warrants for failure to pay traffic tickets, it is not the clerks who can waive the requirement that he turn himself in. In order to handle the warrants for you, the best outcome is usually obtained by hiring a lawyer in the county where the warrants are from to help you navigate this... View More

Venue is the legal term for where a legal case can be tried. If the crime and arrest were outside the city limits jurisdiction of the Millbrook officer, then your criminal lawyer can file an appropriate motion to dismiss the charge for improper venue.

Q: Can I defend against an unsworn complaint issued by an officer in the form of an "e-ticket" under 32-1-4(a)?

At bottom of ticket, it states "no signature required pursuant to 32-1-4(a)", but that code appears to be stating that the violator would be deemed to have given a written Bond to appear, not waiving officers' need to sign the complaint. Violated Montg. Municipal Ord. 1-9 adopted 32-6-65

Q: If you get a speeding ticket and the vehicle, tag and address info is completely wrong, can it be dismissed?
Barbara H. Agricola

the ticket is written to the individual, not to the vehicle. so no, it cannot be dismissed if the information associated with the car is incorrect. that would incentivize people to put incorrect info down and never have to pay a ticket if that were the case.

The answer depends on the reason the officers state was the reason they pulled you over. IF, and that's a big IF, the officers had no legitimate reason for the stop AND IF they admit that, the marijuana they seized should not be admitted into evidence against you. If, on the other hand, the... View More
