I was driving and I sped up to make it past the light that I felt was about to turn yellow. There was only one other car on the road and it was a truck in the next lane. I passed the truck but started to slow down once I made it past the light, but the truck was following me and it was dark.... Read more »

Based on everything you said, you should be hiring a lawyer to handle this for you. Every case is different so it is not possible to tell you what you will get unless you hire someone. We have seen some judges give people 3+ days of jail for criminal speeding first offense. Other judges might be... Read more »

Hi there! Yes you can definitely pursue options to get reimbursed. Under Arizona law, another driver’s negligence can be a recoverable tort.

Thank you for the question. It could mean that a bench arrest warrant was issued. I would need more context to be able to answer the question accurately. If indeed an arrest warrant was issued, if you come into contact with law enforcement they will arrest you and take you to jail. You should reach... Read more »

You would likely be charged with failure to control your vehicle (infraction) and leaving the scene of a property damage collision (misdemeanor). You will likely face a fine and a serious increase in your cost of insurance.
I have two charges that were based on thr black box of the car (Event Data Recorder) extractEd 4 months after the accident. The charges are speed and Reckless Driving.
The officer who charged me had no experience dealing with the EDR, and I had an altercation with him which resulted in me... Read more »

The judge is correct the time to argue facts are trial. I understand this is not the answer you were hoping to hear, in criminal cases there is not a Motion for Summary Judgment where you are permitted to get a ruling of guilty or not guilty based on undisputed facts prior to trial. No! You still have constitutional rights that protect you and your families. When it comes to being pulled over, the police must have a valid reason to pull you over. They cannot use the stay at home order as justification to pull anyone over and question them.
On the incredibly off chance... Read more »

In Arizona, we do not have a law that allows for expungements. However, we do have a law that allows for "Set Asides". This essentially is the AZ equivalent of an expungement or sealing records.
In your situation, it seems as if these offenses occurred 15 years ago and you were... Read more »

Hello. You will need to contact an attorney in the city/town/county were the conduct occurred. Attorneys can only represent people in a State where they are licensed to practice law so it is unlikely you will be able to hire a local Phoenix attorney that is also licensed in New Mexico. I received a citation today in el mirage. The officer did not fill in the date of the incident. The space is blank. The only date on the citation is the court date. Can this be dismissed?

Sometimes facial errors are enough to have a ticket thrown out; the clerks may not be about to enter the ticket information into the court system without a date. BUT, the cop can always fill it in on his copy and file it that way. The cop's copy is the ticket, all you have is a carbon copy.

The answer is fairly simple however the process can be complicated. Essentially, you have to contact the MVD and have them provide you a copy of your driving record. You can typically do this online or in person. Then, on the report you will be able to see which court, if any, have a hold on your... Read more »

There should be some type of case number on your ticket, usually at the very top. If not, you will need to contact the court where the ticket was issued.
