When you rear end someone it usually is your fault. The law states you should only be going as fast so that you can stop if the vehicle stops in front of you. did your driving cause you to CUT OFF another car, that then got in an accident?

if they can prove you were negligent, then they could present a claim... with enough evidence.

however, I think it would be an uphill battle for them without good independent wits

Assuming that this collision occurred in CA, if you carried UM insurance, you can make a claim to it to cover your injuries and damage from the hit and run, including, medical expenses, pain and suffering and loss... Every case is different, but it sounds like your friend is 1. not represented by a lawyer and 2. is still negotiating. She needs a lawyer to get her the best money recovery. It's really that simple. Its not clear what you are asking. Your insurance company has a duty to defend (retain a lawyer on your behalf) and indemnify you (pay any settlement or judgment up to the policy limit). If your insurance company is disputing coverage, you need an attorney who specializes in handling insurance... Read more »

You can retain an expert to provide an opinion or cost estimate for the repairs and have them present those opinions or explain the estimate at a small claims hearing. I am not certain, but I doubt you can recover the experts fee in a small claims hearing.

You should tender the matter to your insurance company. They can likely appoint an attorney to represent you. Although there is no lawsuit yet, the fact that the other side already has an attorney and they are contacting you, indicates the likelihood the other party will pursuse the matter. If you... initially i would think you would want to talk to a LOCAL Personal Injury Lawyer.

a far as suing CHP, that is always an uphill battle.

They may still be able to file and you can contact the local DA's office.

I still don't understand the facts.

however, it is no different from being in a minor fender bender. The car still works and is driveable but there is property damage.........etc

IFFFFF you are responsible, then you either turn it over to your insurance co or you are PERSONALLY LIABLE and possibly retain a lawyer to defend you.....if the amount if large enough.

Q: My car insurance had me complete an examination under oath.

After I completed my euo, I felt like a messed up on some of the questions but the attorney that represented my insurance company said they will mail me a transcript of the euo what does that mean and I can revise it ? Is that true ?

call the police to report the theft.

send a letter to Tow Yard setting forth what happened with copies of pix.

demand reimbursement and if no response or no payment, sue in small claims court.

Q: How long after receiving a car insurance claim check do I have to make the repairs?

I received my claim check end of 21’ or early 22’ and I am disabled and unable to get it repaired until now and the check is not enough to cover the repairs.

Q: I'm a plantiff and I have a motion to compel what do I need to do so it doesn't get dismissed. I'm in pro per.

Motion to compel why it shoulder bbe dismissed. On me the plantiff . Bit I have what they want my file med bills etc . Case is foe 5million . It's been 4 yrs ghreedi and keese was my law firm . Then not . Week before my trial date I was waiting for 2 yrs .
