The other person’s insurance company did not provide me with a rental and after 14 days they totaled it. I have since lost my job. Is medical part separate or is medical and the accident lumped together?

In Kansas, consider several steps if you're facing repair costs for your car hit by a U-Haul truck where the driver lacked proper insurance. First, check if your auto insurance includes uninsured motorist coverage, which could cover such incidents. If this is not viable, you can file a lawsuit... View More

So long as the statute of limitations has not run on the claim (usually 2 years in Kansas and 5 years in MO), you should still be able to pursue and conclude the claim. If the police officer is more than 50% at fault for the collision, then the city he works for will be liable for that percentage of all your damages. Your damages will include medical expenses, lost wages, and pain and suffering damages. The city most likely has some form of insurance to cover this... View More

Read the terms of your insurance policy and your premium invoice. If you have full coverage, or if you paid for full coverage, you may be able to sue your insurance company.

If not, you may be able to sue your insurance agent for not obtaining full coverage despite your instructions to do so.

I had no insurance at the time but I should not be the only one held accountable for the accident nor have to have a release of liability if we both were at fault. He did not use a turn signal which caused the accident
