You may be limited in claiming pain and suffering damages if you were uninsured, but there are a number of exceptions. Even in a worse case scenario, you can still claim medical expenses (past and future) as well as lost wages (past and future).

Is it a warrant or a summons? If it's a warrant for failure to appear were you notified? I suggest you talk to an attorney in that county who handles misdemeanor criminal cases. Did you tell the police your car had been stolen?

Bigger problem is if it was close enough that you might hit it you have an obligation to avoid hitting if you could have. For instance if you have a van with a high roof, you would want to get out, check it out, and if close just don't go there.

If you were not driving and another hit you negligently, then yes, you do have a claim against the negligent driver. There is a two year statute of limitations in Kansas, and you amount of recovery will be dependent on the extent of your injuries.

You may. Generally you will be found at fault as you are the backing vehicle, however if it was dark and she had no lights you may have a claim.
