You would generally have three years to file a claim with, and then sue if necessary, your insurance company for an uninsured motorist claim. There may be other claims with shorter time frames. You should consult with a lawyer in a confidential setting.

Generally yes. You have the same statute of limitations as you would if there was a defendant you could name. But you want to consult with a lawyer to see if the general rule matches the unique facts of your case.

In short, yes. If you know the identity of the driver, you can sue the responsible party within three (3) years, per Maryland's statute of limitations. If you do not know the identity of the driver and can satisfy your own insurance carrier (usually through the production of a police report... View More

Although your post does not indicate for whom the driver of the truck was employed, insurance coverage for the vehicle being operated, unless operated without permission of the vehicle's owner, generally applies to cover damages caused by a negligent operator.

As soon as i got my car to stop, I said to call the police to the house members, but they came and dragged me out of my car, held me down and didn’t let me call anyone for 5 min. I felt hopeless. Your attorney should answer this question for you.

It can take a long time, many months, sometimes years, to do all that is necessary to even ask for a settlement, and longer to get a settlement. And, if a lawsuit is filed, it can take years to get to trial.

Not guilty does not necessarily mean you were not responsible. So this question cannot be answered without knowing all of the facts. But the not guilty does not necessarily release your potential liability

The vehicle turning left in your scenario must yield the right of way to the vehicle coming in the opposite direction and making the right turn. The vehicle making the left turn is at fault for the accident.

Q: If driving on a two-lane bridge with no median and youre in an accident, keep driving until youre off it, or pull over?

I recently saw a dashcam video where an individual was driving on a two-lane bridge (with no median or place to pull over) on the left-hand lane when a car cut them off from the right lane merging into their lane. They hit the car and swerved right, continuing to drive. Would that be a hit-and-run?... View More

The person is supposed to pull over to a safe location so as not to impede traffic and then stop. If the person does that, it is not a hit and run.

No, you cannot sue the police for failure to write a ticket. They have absolute discretion on whether to issue a citation. Regardless, issuing a citation does not determine fault. You can sue the other driver and your own insurance company if he is uninsured and if you win, your rates will not go... View More

It could affect your rates. Insurance companies usually ask if you have had any accidents in the last three years when you renew and they may have access to the information anyway when they go to renew.

You can receive probation before judgment for a moving violation in Maryland. You need to request a trial within 30 days of the hearing and go to court. However, for CDL purposes, a PBJ can still affect your CDL since under federal law, PBJ's are the same as a conviction.

A agree with Mr. Kirk. When you are making a u-turn, and you turn into the pathway of oncoming traffic, you are the one who fails to yield the right-of-way. To prevail in court, you would have to prove that excessive speed, and excessive speed alone, of the other vehicle caused the accident, and... View More
