Q: Daughter is perm. resident of FL, got a ticket in MO. in October 2022. Ticket was pd. Can it be ammended for insurance?

Yes, an experienced traffic law attorney may be able to withdraw her guilty plea and get the ticket amended. However, the outcome depends on 1) which court her case was prosecuted in, 2) how fast was she driving, and 3) how much time has passed since she pleaded guilty and paid the fine.

Q: In Missouri do tickets that are mailed to you hold up in court?

My son got a ticket mailed to him saying he ran a red light back in December and got the ticket in March. How well do these tickets hold up in court or is it worth fighting

It is legal in Missouri for a court to mail a ticket to a defendant.

A red light violation is a moving violation, so your son can hire an attorney to get it amended to a non-moving, no-point infraction so it won't affect his driving record or car insurance rates.

Q: My husband got 2 tickets on 3/11/22. Both are infractions. Neither were filed until 2/15/23. Is that within the statute

Of limitations? The first was for a windshield and window tint and the second was for having a tinted plastic cover on his license plate.

Yes, this was filed within the 1-year statute of limitations. The Prosecutor has 1 year from the date when the ticket was issued by the police officer to file the charges.

Q: Can an officer issue a second citation days after issuing the first citation?

Pulled over on the 11th for failure to register. Was issued a citation. I looked on Casenet and the officer had issued a 2nd citation which I was not even aware of.

Yes, the police officer issued the ticket, but then it went to the Prosecutor, who can add an additional charge if they want.

Q: If a cop gave me a printed out ticket but never asked me to sign it is the ticket valid it's on his vehicle camera

I got the ticket in Missouri but while in his vehicle when he gave me the ticket on camera he never asked me to sign it on any of the signature spots is the ticket valid he didn't sign the printed out ticket anywhere either

Yes, the ticket is valid. It makes no difference if the police officer didn't sign the ticket or if you didn't sign the ticket. After the police officer issues a ticket to a driver, the prosecutor has to approve the ticket, and then it goes to the court clerk to be filed on Casenet.... View More

Q: I got a speeding ticket 11/2/20. The court date on the ticket was 2/10/21, but court was cancelled due to Covid.

Now, a year later, CaseNet continues to say 'case with PA'. Is this beyond the statute of limitations? When I called the court they said if there is no new date in a year I can forget about the ticket. True?

Not necessarily. The Prosecutor has 1 year from the date of the incident to file the charge. It is possible that the Prosecutor filed the charge within the 1-year statute of limitations, but the court clerk just hasn't set the case on a docket and notified you of the court date yet. Misspelling of your name and other minor errors on the ticket are not sufficient to get a ticket dismissed. Any errors can be corrected by the police officer or Prosecutor at any time.
