Q: Car accident, I was dui tested but the other driver was not. Is that right or should she have been tested as well?

I was involved in a car accident and the officers did a dui test on me but they never tested the other driver. I’m not claiming that she was drinking just doesn’t seem right to me. I was claimed at fault because I was making a left hand turn. As the ticket states failure to yeild at an... View More

No, it's because cop felt you may have been driving. He needed "probable cause." if she didnt' appear to have been drinking, no reason to test her.

Left turn vehicle has duty to yield.

Unless she came through on a yellow light for her, I don't see her being at fault.

You need to talk to a bankrupcty attorney --look for a member of the NACA --go to consumeradvocates.org

Ask your insurance company to divide up the payments and get releases.

Look at your policy. Do you have homeowners? Check and see if that covers any excess liability.

If...

Fight the reopen. She has I assume filed a motion to reopen. May be worth your while paying a defense attorney to at least advise you.

By the way your being without a license doesn't make you at fault. You are only at fault if you cause the wreck. Makes sense for you to get a copy of...

Understand you won't get 24 k if you want the car--you have to buy it back from them for salvage. Looks like you are getting a decent deal--take it. You say the wreck was deemed your fault. If you agree fine. If not, why not contact a member of the Nevada Trial Lawyers Assn--they give free consults.

I suggest you sit down with the attorney in person to review things. You may always change attorneys but a new attorney may have a concern about jumping in the middle of something. There are time lags in litigation, so I'm not shocked--the lawyers office is doing a not good job of advising you... View More

He can if allowed by local rule serve a subpoena to appear in court , but not to ask questions--just to give it to youi.

I don't know if Arizona has "stacking" or if you can add your uninsured motorist, but the problem is that the attorney can only get the coverage the person has on their policy. It could be 25, it could be more.

Question is can he negotiate with health insurers to say you get...

Well, you get an estimate of cost of fixing your car (to show it's totalled, offer the biker the option to take the car by paying it's total loss value, scrap it, tell biker if he doesn't pay or turn over valid insurance you will ask to have his license suspended, then file with the... View More
