Q: I Failed to stop at stop sign. Ticket has a court date on it, cop says it’s not mandatory, just wanted to be sure.

This is the second ticket since May. I will plead guilty because I don’t want to go to court. I just wanna make sure when I do that I don’t have to show up for my court appearance.

If you send in your ticket with a guilty plea you do not need to go to court.

Thank you for your question. Is it possible that the notice you received was from the New York State Department of Motor Vehicles and not from the court where your ticket was handled? While your question seems to indicate that you do not have any other points on your license, it may be helpful to... Read more »

Thank you for your question. The first thing I would recommend is that you contact the attorney who handled the ticket (and got it dismissed) for you and see if he/she can explain or look into the cause of the suspension.

Additionally, if you haven’t looked at a recent copy of your...

Q: Would I lose my driving privileges or just get fined?

This is my first time getting a ticket. Had two of my sons 16&17 up on the roof, told them to knock it off and when they were bout to go down, cops pulled us over. Should I fight for a trial or just plead guilty? If I do, will I lose my driving privileges?

Honestly, you are lucky if you are not charged with child neglect. Never plead guilty. Get yourself a good lawyer.

You posted in traffic tickets---assuming you are seeking a lawyer for representation of a traffic ticket, then you would have to convince a lawyer to represent you as you have no constitutional right to a lawyer for a traffic ticket. On the other hand, if you are charged with a crime (misdemeanor... Read more »

Howard E. Knispel answered on Apr 22, 2021

While it sounds unfair, the law requires drivers to know that the vehicle they are driving is properly registered and insured. You can argue that it was not your vehicle, but you may be held responsible for driving an unregistered and uninsured vehicle.

Q: Can you get a hardship drivers license in New York if you are 16.
Toshinori Isoai
Toshinori Isoai answered on Mar 15, 2021

More information is needed for a better answer. A grant of hardship privilege is based upon the finding of the statutory conditions and not just your age. But if you are 16 and in high school, you will not allowed any privilege if you just want to drive to and from a high school.

Not sure what the question is. If you ignore the ticket, your driver's license will be suspended in both NY and NJ. If you pay the ticket in NY you will have a record of conviction in both NY and NJ. Do you want to fight the ticket?
