This might be a difficult question to answer - that could be why it remains open. It's a little open-ended, instead of a specific issue, such as right-of-way in a traffic circle. Until you are able to consult with a traffic ticket attorney, another thing to keep in mind is the intellectual... View More

Q: Will I face jail time

I got into an accident. I called the police and they tell me my drivers license is suspended due to an uninsured vehicle. I was not aware of this as I have an active insurance policy. It really depends on your history and the incident. Normally driving with a suspended license for the first time would not result in jail. You need to speak to an attorney.

If you did not have full knowledge of the consequences of your plea at the time you made it. You could hire a lawyer and motion to revoke the plea and attempt to resolve the ticket a different way.

Did you resolve the ticket in 2022? If not, then you have a default. That is what likely caused your suspension. Resolve the ticket and you can get the suspension lifted.

If you have a DL issued by NJ, and it is suspended, you cannot drive in NY. You should contact an attorney practicing in this area of law right away. Thank you for using Justia ask a lawyer.

Q: Can you go to jail for a stop sign ticket?

Why would they say I need to go in person for a stop sign ticket if I already pled filthy and said I’d pay? Would a lawyer make sure I don’t go to jail?

It depends on which court the ticket is filed in. Assuming you got this ticket in NYC, they want you to come to court to decide whether to suspend your driver's license for too many points.

Technically you should not have gotten a court date. However if you have priors, or open tickets they can require a hearing. But this might be a blessing. You can negotiate the plea and get a better deal.

You need to answer the ticket by mailing it to the court and pleading not guilty (there is a space on the ticket to do so along with a deadline). Keep a copy before you mail it. A court date will be given to you to plead your case to a Judge. You can higher counsel to do this for you as well.
