So I was on the highway and was pulled over for speeding and failure to use turn signals and for my tints. The cop did not give me a ticket for speeding and gave me a ticket for failure to use turn signals and tints. If i plead not guilty and go to court can he bring up the fact that I was speeding... Signal violation (VTL 1163) is an independent violation. Unless you have also been charged with reckless driving (VTL 1212) or following too closely/tailgating (VTL 1129), etc, the fact of speeding itself will not be relevant to your signal violation.
If you were walking and were asked to blow for being intoxicated its different than driving.

I travelled to Newyork for vacation and got two tickets Avoca Town(speed in zone, failed to use designated lane). I was overtaking a car using the right lane(2 lane freeway) and so the speed was also a little above the limit . It's interrelated but I got two tickets. Kindly help... Read more »
First, 20 miles over the speed limit is more than "a little" above the limit. You list Manhatten as the place, but I do not believe there is any 65 mph zone in Manh. The place you got the ticket is important because NY handles tickets differently in different counties and towns. In some...Read more »
I got the speeding ticket in weschester county. There's a court date on it. Do I need to go and what should I do, plead guilty or not guilty? Since i'm switching my license to Connecticut in a couple weeks will it affect it? Also will points get transfered over?
So if I were you I’d just hire an attorney (my office and others here handle them). Allow an attorney to defend the ticket and or negotiate it down to some kind of infraction to minimize or eliminate any points. The points will follow you so it’s the worst thing to do to plead guilty. Feel...Read more »
In Staten island NY, parked my car at the very end of a bus stop (50 ft from 1st sign) came back to my car and had a Ticket, I noticed a pole to the right of me with a missing sign, there were a line of cars directly behind me, I googled the street and it showed that once there was a bus stop sign... You make a valid point with a missing sign, and you provided photos as proof. It could sometimes be difficult to predict exactly how the City will rule, but it looks like you did everything in your power to present a persuasive case. Good luck
Not having a supporting deposition is not grounds for dismissal. You can request one when you send in your not guilty plea. Often, a supporting deposition is the second page of the ticket, sometimes even attached to it. You could try to use the fact that the trooper said it was there but...Read more »
I was pulled over in a 30 MPH zone and the cop said he got me at 61 MPH. I wasn't looking at my radar but from my peripheral vision, I don't believe I was going over 60. I know that in NY that one more MPH is a much larger fine, the cop was trying to bump my ticket up to the next level. I... Read more »
Seriously consider retaining an attorney to negotiate your ticket down to an infraction of some kind. Generally the attorney will appear before for you. Feel free to call my office (or anyone here who handles these matters) and don’t worry too too much! That’s what we are here to do. To take...Read more »
my brother used my information when he was pulled over during a traffic stop and entered a guilty plea for the tickets he received he's now incarcerated and I'm just now finding out about this situation and I just received a ticket in the amount of $776 saying I have to pay it by 10/27 I... Would I be correct is saying that if I request discovery from the Prosecutor/State Police Officer and they do not provide me with what I ask, they subsequently would not be allowed to present the previously requested evidence in court?
I think you mean if you request a supporting deposition. Sometimes it's already on the ticket. You're well advised to have an attorney handle this matter for you. I know it may seem funny coming from an attorney. However, very often those prosecuting traffic tickets will negotiate...Read more »
What do you do? Reach out to an attorney for a quick consult. Many attorneys would offer you a free initial consult to outline your options and their fees. I have a New Jersey license plate and driver's license and I received a uniform traffic ticket a few days back in upstate New York for one of my headlights not functioning. I’m a green card holder and have my final citizenship interview this month. The misdemeanor was from driving with an expired drivers license and getting rear ended (I’m not at fault for accident), but the officer said if I can renew my license before my court date, it should be able to be... There's no way of telling whether or not the misdemeanor will effect your immigration status without more details. Also, as far as renewing your license, it's rather straightforward now (make an appointment, or do it online). Consult with a law office who will try to get the ticket...Read more »
This is my second time getting pulled over ever and the first time was for a headlight, I’m 18 years old and about to go to SUNY Plattsburgh he caught me on radar going 92 but when I looked at the speedometer it said 79 do u think I should plead guilty or not?
Your post remains open for three weeks. You may have resolved the matter by now. But if you haven't, traffic ticket attorneys do charge for their appearances, but if you reached out to them to briefly discuss, many do offer free initial consults. In light of the financial situation, if you...Read more »
I also know that it depends on the angle of the gun and that they are not very accurate this officer was also telling me that it would be very easy to get out of it He was not very professional I tried asking what I did before providing my id but he wouldn’t tell me until I did and after he came... I intend to plead guilty but wanted to explain how this happened. I was in a small convenience store parking lot and someone parked very close to me. I was trying to navigate around him and when I turned the wheel, I backed into an old gas pump. I did no damage to my car, but when I hit the... Read more »
