You could file a civil lawsuit against him instead of pursuing a criminal case. But if you choose to do so, expect the defense to note that you did not pursue criminal charges and argue that shows it wasn't a big deal.

You have to decide what amount you want to settle the claim, understanding that it will likely result in an offer lower than what you demand. Take into account medical bills, list wages. And pain and suffering at the very least when making a demand.

Maliciousness is not an element of an Assault case. All that is necessary is that you prove that a person knowingly caused or attempted to cause physical harm to another without the other person's consent. So, malice is not an element.

You have a low likelihood of being deemed to have admitted fault by giving a refund. Businesses give refunds for things for unhappy customers all the time.
