Q: can a prosecutor give you their opinion on how judge will rule while offering you plea bargain?

i heard pros say it’s highly unlikely i’ll be convicted but he still wanted to offer me a reduced charge. The words highly unlikely motivated me to refuse plea. Then, I was found guilty. Next day I called pros and he denied what he said. He said he may have said it’s highly unlikely i’ll... View More

The prosecutor is free to offer his or opinions. You should not listen to them seeing how their job is to convict you.

Q: Could a speeding be " thrown out" if the wrong model of car is showed?

Also he had be going faster than what I was. I had my cruise control set for 75 and the speed limit was 70. He said he clock me going... View More

Based on your post, you have admitted you were speeding, but that the law enforcement officer noted things which are in error. The prosecution has the burden of proof and would call the law enforcement officer who would identify you as the operator of a vehicle which was exceeding the speed limit.... View More

Q: I need to pay court fines in Sydney Australia. I’m in the states. I’ve been told pay through Bitcoin

I’ve been told the court only excepts payment through Bitcoin. I find that hard to believe. Is this a scam? My friend hit a parked car but didn’t stop. There was no injuries. He is under house arrest now. I’m not comfortable paying that way

While you should ask a lawyer in Australia, technically, this seems like it is almost certainly a scam.

Q: My son was in accident and at fault. He had no insurance. On the ticket they put the wrong first name.

Will he have to show proof of insurance in court or will it be thrown out? There were no injuries but both cars totaled. The ticket said the offense was "stop sign". It also says he does not need to appear in person. Can this be thrown out without showing proof of insurance?

Tickets with incorrect names on them do not get thrown out. They get corrected. He is going to get a license suspension from the BMV for not having insurance.

An Ohio attorney could advise best, but your question remains open for three weeks. It's possible you could have a basis for recovery - but only an Ohio attorney could advise for certain what types of damages are included or excluded. In many jurisdictions, those violations on your part could... View More

Q: Is it illegal to make a left turn over solid double yellow lines in Ohio? Additionally, are U-turns always illegal here?
Matthew Williams
Matthew Williams
answered on Sep 8, 2021

I know of no ordinance that prohibits turning left over double yellows to enter a driveway. Crossing them for any other purpose is generally unlawful and it is possible that a municipality has outlawed crossing them even to get to a driveway.

In Ohio generally, you can make a U-turn...

Q: I got a speeding ticket, sheriff was sitting in a driveway to abandoned property for sale. Is that legal ?

Meaning is that legal for him to be sitting there? Does law enforcement need permission to be parked in driveway of private property in Ohio? Also was half mile from where limit posted I would have been legal. And I had no traffic, clear road conditions

It is legal for anyone to enter a drive way and sit there so long as the owner doesn’t show up and ask you to leave. If you were to disobey, you would become a trespasser. Even if the sheriff shouldn’t have been there, it has nothing to do with the fact that you were speeding just like the fact... View More

Yes, that can be an additional criminal charge. I suggest sitting down with a criminal defense attorney in your area to discuss. Keep in mind that attorneys cannot solicit or contact you directly, you will need to initiate contact.

Best of luck.

Q: Will a ticket show up in a court date that doesn’t have a verdict yet?

I got a ticket on a freeway for going 19 over. Then got pulled over a few days later doing 19 over on a business road. My second one is first and I’m wondering if the first ticket will show up on record since it doesn’t have a verdict yet. Also, what is the best way to go about going to court.... View More

You should speak with an attorney to represent you as both of these tickets likely carry at least two points. An attorney may be able to knock down the moving violations. Are both tickets issued by the same municipality? I'd assume not, but it would be worth knowing. As to your question, open... View More

It sounds like a defensible case. For a definitive answer you're going to need to sit down with an attorney to review the facts in detail and figure out the best game plan. Sometimes these issues continue on if the other driver tries to sue you civilly.

Q: I have a friend who is in federal custody for possession of 2 kilos of Meth. I don't think the traffic stop was legal.

They were driving a rental car. They were pulled over for the tags not matching the car. Unfortunately, then answer is, it depends. If the officers acted in good faith and the information they had would have established sufficient grounds for a traffic stop, it will likely be upheld by the Court. Ultimately, that's an issue that would need to be raised in a Motion to Suppress.... View More
